SeniorCarefully Terms of Service

Welcome to SeniorCarefully. By accessing our website, utilizing our matching technology, or uploading documentation, you agree to be bound by these Terms of Service.

1. Scope of Service

SeniorCarefully LLC provides a Digital Marketplace and Technology Portal designed to connect Families/Seniors (“Clients”) with Adult Family Homes (“Providers”).

  • Not a Medical Provider: SeniorCarefully does not provide healthcare, medical advice, or nursing services.
  • Not a Placement Agency: We are a technology platform. We do not personally recommend or "place" seniors; we provide the infrastructure for Clients to receive and compare quotes from Providers.
  • Independent Entities: Providers are independent business owners. SeniorCarefully is not responsible for the care, acts, or omissions of any Provider.

2. The Quoting Engine & "Transition Vault"

To facilitate care matching, SeniorCarefully utilizes a proprietary quoting system:

  • City-Wide Matching: When a Client uploads a medical assessment, it is shared securely with licensed Providers within the searched geographic area (City/Zip).
  • Privacy Firewall (In-App Only): To protect Client privacy, personal contact information (Phone/Email) is hidden from Providers. All communication, including quotes, messaging, and tour scheduling, must occur exclusively through the SeniorCarefully Secure Portal.
  • Provider Response Window: Providers are encouraged to respond to assessment shares with a care quote within twenty-four (24) hours.
  • Data Minimization: Once a Client "Books" care with a specific Provider, the clinical assessment is immediately revoked and removed from the dashboards of all other non-selected Providers.
  • Auto-Deletion: All clinical documents are permanently purged from SeniorCarefully servers thirty (30) days after upload.

3. User Responsibilities

  • Accuracy: Clients agree to provide accurate health assessments to ensure safe and appropriate care quotes.
  • Authorization: By uploading a document, the Client warrants they have the legal authority to share the Resident's Protected Health Information (PHI).
  • Prohibited Use: Users may not "scrape" data, create fraudulent listings, or use the platform to harass other users.

4. Payments, Fees, & Circumvention

  • Initial Payment: All move-in payments (deposits/first month's rent) must be processed through the SeniorCarefully platform via Stripe.
  • Circumvention: If a Client and Provider were introduced or exchanged assessment or contact information through SeniorCarefully, the initial move-in / first-month payment must be completed on the platform. Attempting to bypass SeniorCarefully (including off-platform cash, check, wire, or peer-to-peer payment) to avoid marketplace fees is a material breach and may result in suspension, recovery of unpaid fees, and permanent account termination.
  • Refund Policy: As part of our "30-Day Guarantee," if a resident departs, is hospitalized, or passes away within 30 days of move-in, the SeniorCarefully platform fee is fully refundable to the Client.

SeniorCarefully Assessment Reimbursement Terms & Conditions

Overview of the Guarantee

SeniorCarefully provides a 100% reimbursement of the initial clinical assessment fee ($350.00 USD) paid to our third-party partner, OnIt RN Nursing Services. This guarantee is designed to offset transition costs for families who successfully find and secure long-term care through the SeniorCarefully platform.

Eligibility Requirements

To be eligible for the $350.00 reimbursement, the following “Qualifying Actions” must be completed in full:

  • Platform-Originated Booking: The user must utilize the SeniorCarefully platform to identify, tour, and select the Adult Family Home (AFH).
  • Verified Transaction: The move-in deposit and initial care fees must be processed through the SeniorCarefully secure quote system.
  • Stripe Payment Processing: All financial transactions between the User and the Adult Family Home must be handled via SeniorCarefully's integrated Stripe payment gateway. Payments made via cash, paper check, or external wire transfers directly to the home owner waive all rights to this reimbursement.

The 30-Day Residency Rule (Satisfaction Period)

The reimbursement is subject to a “Satisfaction Period” to ensure the placement is stable and the senior is satisfied with the selection.

  • Holding Period: Reimbursement funds will be held by SeniorCarefully for a minimum of 30 calendar days following the official move-in date.
  • Active Residency: The resident must remain in the selected Adult Family Home for the duration of these 30 days.

Forfeiture and Void Clauses

The $350.00 reimbursement offer shall be rendered null and void if any of the following occur:

  • Early Departure: If the resident vacates the facility, transfers to a different home, or terminates the residency agreement for any reason within the first 30 days of the move-in date.
  • Off-Platform Agreement: If the User negotiates a lower rate or alternative payment terms with the Home Provider outside of the SeniorCarefully Stripe system.
  • Medicaid Conversion: This offer is strictly for Private-Pay residents. If a resident converts to Medicaid or state-funded programs prior to the 30-day mark, the reimbursement is void.

Redemption and Disbursement

  • Verification: On the 31st day of residency, SeniorCarefully will verify the status of the placement with the Adult Family Home provider.
  • Payment Method: Once verified, the $350.00 will be credited back to the original Stripe payment method used during the booking process or issued via ACH transfer.
  • Timeline: Please allow 7–10 business days for the funds to reflect in your account following the 30-day verification.

Limitation of Liability

SeniorCarefully acts solely as a facilitator for this reimbursement. The clinical assessment is performed by OnIt RN Nursing Services, an independent entity. SeniorCarefully is not liable for the clinical findings, delays in scheduling, or any disputes arising between the User and OnIt RN.

5. Limitation of Liability

SeniorCarefully LLC provides its services on an “As-Is” basis. We are not liable for:

  • The clinical suitability of a home for a specific resident.
  • Any injuries, medical emergencies, or disputes occurring at a Provider's facility.
  • Any loss of data or technical interruptions beyond our reasonable control.

6. Dispute Resolution

These terms are governed by the laws of the State of Washington. Any dispute arising from these terms shall be settled via binding arbitration in King County, WA.
